We build brands. From start-ups to global enterprises, branding is one of a company’s most important tools, and trademarks are one of a company’s most important assets in its branding toolbox.

With brand recognition and loyalty often at the heart of any business’ survival, it’s important to have a law firm on your side with a nuanced understanding of both the law as well as the challenges and benefits of protecting your company name, slogan, logo and other things that make your business unique. We represent a wide variety of individuals and businesses before the U.S. Patent & Trademark Office. (“U.S.P.T.O.”) to get, keep and enjoy trademarks that define their brands, attract customers and help their interests grow. We also understand that our clients need to be able to budget for legal services, and offer many of our trademark registration services for a flat fee. At Breyer Andrew, our brand is protecting yours.

Our trademark and other intellectual property services include:

We’re with you from start to finish. The trademark journey typically begins with an initial (knock-out) search, followed by a comprehensive clearance search, to try to determine whether your desired mark is available before filing. We’ll advise you on whether our search turned up any reasons why your application might be denied, and any options you might have for dealing with those reasons. We’ll prepare and file your domestic trademark applications, respond to any questions (“office actions”) from the U.S.P.T.O. and keep you posted on the status of your application as it moves through the trademark process. For international registrations, we work with a network of attorneys around the world to try to determine and apply for registration in the most appropriate territories.

Portfolio Management

Obtaining a trademark is a great step toward protecting your brand, but it’s only the first step. That’s because the U.S.P.T.O. only protects your brand if you do too. Throughout the life of your trademark, we can help you police any potential competitors’ future trademark applications, as well as the internet generally, with various monitoring services to try to identify any possible infringers early. We can also prepare and file required renewals to keep your mark in good standing.

Enforcement & Defense

If someone is infringing on your mark, or claims you are infringing on theirs, we’ve got you covered. Whether the situation calls for drafting a cease & desist letter, negotiating a coexistence, consent or licensing agreement, or appearing before the Trademark Trial and Appeal Board (TTAB) for opposition or cancellation proceedings, we’ll be by your side.

Other services:

Copyrights for creative works are often another important tool in the branding toolbox. As with trademarks, we assist clients with services from initial filing to dispute resolution. We also offer copyright registration services for a flat fee. A representative sample of the copyright services we offer includes:

  • Copyright registration & assignments
  • Various licensing and work-for-hire agreements
  • Digital Millennium Copyright Act (DMCA) notifications
  • Negotiation and Litigation

Strategic Planning

While many of our clients already have a marketing vision for their brands, if you’d like to bounce ideas around with us, we offer consultation and strategic planning on an hourly basis.

Trade Secrets, Fair Use & other civil litigation

We have nearly two decades of experience in all phases of civil litigation for a wide variety of claims and causes, from filing the complaint through motion practice, discovery, bench and jury trials, to appeals. We represent individual and corporate plaintiffs, defendants and third parties, in both state and federal court. Whatever your stake is in a matter, we’ll work with you to develop a litigation strategy that best balances your goals and budget. Even as litigators – or perhaps because we’re litigators – we believe that litigation should only be used as a tool of last resort. If and when that time comes, we’ll be by your side.

If any of your goods or services might warrant patent protection, we’re still here for you. As with foreign TM registrations, we work with a network of experienced patent attorneys who share our values and drive for high-quality, cost-effective service.
