Registration
We’re with you from start to finish. The trademark journey typically begins with an initial (knock-out) search, followed by a comprehensive clearance search, to try to determine whether your desired mark is available before filing. We’ll advise you on whether our search turned up any reasons why your application might be denied, and any options you might have for dealing with those reasons. We’ll prepare and file your domestic trademark applications, respond to any questions (“office actions”) from the U.S.P.T.O. and keep you posted on the status of your application as it moves through the trademark process. For international registrations, we work with a network of attorneys around the world to try to determine and apply for registration in the most appropriate territories.
Portfolio Management
Obtaining a trademark is a great step toward protecting your brand, but it’s only the first step. That’s because the U.S.P.T.O. only protects your brand if you do too. Throughout the life of your trademark, we can help you police any potential competitors’ future trademark applications, as well as the internet generally, with various monitoring services to try to identify any possible infringers early. We can also prepare and file required renewals to keep your mark in good standing.
Enforcement & Defense
If someone is infringing on your mark, or claims you are infringing on theirs, we’ve got you covered. Whether the situation calls for drafting a cease & desist letter, negotiating a coexistence, consent or licensing agreement, or appearing before the Trademark Trial and Appeal Board (TTAB) for opposition or cancellation proceedings, we’ll be by your side.
